(d) The fact that a new vehicle’s failure to conform to an express warranty is the result of abuse, neglect or unauthorized modifications or alterations is an affirmative defense to claims brought under this Act.
(e) The statutory warranty period of a new vehicle shall be suspended for any period of time during which repair services are not available to the consumer because of a war, invasion or strike, or a fire, flood or other natural disaster.
(f) Refunds made pursuant to this Act shall be made to the consumer, and lien holder if any exists, as their respective interests appear.
(g) For the purposes of this Act, a manufacturer sells a new vehicle to a consumer when he provides that consumer with a replacement vehicle pursuant to subsection (a).

Free Attorney Review

  1. I purchased a new Nissan Pathfinder for 38 Thousand dollars from AutoBarn in Evanston, Il on Friday, May 22, 2015 late in the afternoon. I left the dealership with 31 miles on the odometer. I did not drive the car on Saturday. On Sunday I drove the car for less that 40 miles and the transmission went out. I called the dealership and had the car picked up from where I was stranded on the roadway. I was just told that the car needs a new transmission. I do not want this car. I want the dealer/manufacturer to give me a different and operable auto. What is my recourse at this point.

    Thanks loads,

    Shirley cArney

    • You have to let them fix it, and if they cannot, then the lemon law will apply. Save all repair orders, call us if its in the shop for more than 30 days or 3 or more times for the same problem.

  2. i bought a new 2014 f150 truck (from an IL dealer, I also live in IL) and it has been in the shop 4 times for a low battery indicator coming on. the first time was at 1017 miles, then 1698, 2970 and 3290 miles. each time they tried to fix and i have the dealership paperwork that i was given each time. I bought the truck in nov 14. Would this qualify under the law? also i have things like extended warranty and sprained in bed liner. is the cost of those items reimbursable under the law?

  3. I bought a 2010 gmc Acadia in. November 2014. In January a large tree branch fell on it. It has been to the body shop 7 times and is currently still there a total of about 55 days all together. Should I look for an attorney this is the second time in the shop in less than a week. It was leaking they so called fixed it and now its back for the same thing leaking worse.

  4. Bought a 2014 Ford Focus in February2014. The car has been in the shop 5 times for what Ford says is a transmission problem. They fix it and it may last for days to month and then it starts jerking again. I tried to trade it in and get a different car but it’s not worth anything because the 2014 Focus is known to have Transmission issues. Would this qualify for the Lemon Law.

  5. I bought a used Nissan Ultima ,paid almost 19000. A year later I went to trade it in and they told me it was in a accident and is worth 7000.The dealer I bought it from said it was just traded in,found out he lied,it came from a auction, never told me it was in a accident. The history of the car said there was uni body damage and potentially dangerous and unsafe conditions. Is there anything I can do.?

  6. Leeanne Hasara

I purchased a new 2014 Chevy Camaro Convertible in Dec 2013. A few days later I noticed a defect in the passenger door and took it back to the dealer and fought for almost 4 months for them to get it repaired, they finally agreed. During those 4 months of waiting on the door issue to be resolved a few of my speakers went out and they fixed that just fine. During this time I kept smelling an odd mildew smell when I would get in the car, I couldn’t figure it out and came to the conclusion it must have been something in my garage. It was now summer of 2014 so the windows and top were mostly down and I thought the smell was gone until I went to vacuum the back floorboard(as no one is ever back there) and pulled up the mat and there was mold all over the left side rear floorboard. I instantly contacted my dealer and took my car up there for them to see. Step 1 of getting this issue fixed was finding the leak, it went to 2 shops for this. Also while trying to locate the leak, the string in my convertible top busted. So after the leak was fixed, it had to go out of town to get the top restrung(2 trips, one for them to look at the other to fix), and then back to the dealer for new carpet because of the mold AND new keys for the ignition recall. All of this originated with the first 8months of having the car. And don’t even get me started and the stinky empty gas tank rentals they stuck me in that were no where near comparable to my car. My car was finally back to new mid December 2014. Well until now, 7/3/15 I was cleaning my car for a road trip and just like before went to vacuum the back and I lifted up the mat and MOLD AGAIN!! This time it was on the passenger side rear floorboard. I called my dealer immediately and waited 3 hours for a call back and nothing so I went up to the dealer and the service manager brushed me off and said he would be with me shortly. In the meantime my salesman seen me and asked what was going on and I told him and he looked at me and said, “it sounds like we need to get you in another car” he took me to go find a manager, that manager was gone since it was the day before a holiday but the Pre-Owned Sales Manager asked what was going on and my salesman told him and all he offered was to Trade Up, my salesman even looked shocked. At this point the Service Manager came out and told me to call Monday and get it scheduled in and this is just unheard of to him. My sales man followed me around the corner and pretty much apologized and said he would look into this a little more. I left Chevy Dealer and called the shop that repaired the first leak and talked to the main guy there and he said he cant believe it, this is just unheard of and he’s rarely heard of the cars leaking like this let alone twice. So Monday came and I called to get it scheduled in and service had no clue what I was talking about but the guy I talked to was the only one there. I called again today and have got VM twice and no return call. So here I am back to breathing mold in for who knows how long. I am just trying to figure out my rights with this vehicle. Not only am I concerned about breathing in the mold twice now, but what is this going to do for resale value(I already looked up my VIN and there are 4 reports on it, I didnt pay to get the details of the reports though), do I have to worry about future rust where water has sat? What if this happens again once I reach my 3 yrs/36,000 Warranty(Im only half way there)?

I have been getting the run around from my dealership in regards to my car and what can be done about it. 2 weeks ago I attended SEMA Show out in Las Vegas and I approached the Chevrolet area and spoke with someone there about all my problems. I have heard from GM twice since then, yesterday being the most recent and she was going to see what my options were and get back to me. In my eyes my car is a lemon and I want to make sure I know my rights. Can you please help?

        Current mileage is 21,514
        Dealership: Friendly Chevrolet. Springfield, IL

Got my car December 2013 and within days I noticed a bubble in the passenger door, took it back to dealership and was told to get an estimate to have it repaired. Estimate was done days later and it took about 9 months to get approved to get it repaired.(Warranty 1)

July 2014 – passenger door speaker was replaced due to distortion and cutting out.(Warranty 2) The following week Service Stabiltrac light came on, per dealership it was engine misfire and reprogrammed.(Warranty 3)

October 2014- Went to vacuum the carpet and noticed mold growing in back floorboard. Advised dealership of this. Water testing was done and not able to find leak(Warranty 4). In the meantime I went to lower convertible top and an internal string was hanging down. The dealership took my vehicle to a company out of town for them to fix, using my gas and putting miles on it. A few days later I received my vehicle back and was told the string would have to be ordered.(Warranty 5)

November 2014- My car went to Law Automotive to find and repair water leak.(Continue of Warranty 4)

December 2014- car went in to get the carpet replaced from the mold. Also spare key fob quit working. They replaced it but still wouldn’t operate anything. They tried to reprogram multiple times and ran into multiple problems including both fobs quit working. At this time they preformed the the recall regarding the keys and ignition. Also got the string replaced in the top, so they drove my car out of town again putting more miles on it. (Recall & continuing of Warranty 4 & 5)

July 2015- noticed more mold on back floorboard, took vehicle to dealership immediately. Scheduled to have it sent over to Law Automotive for water testing and repair. Was without my vehicle for 28 days and received vehicle back with leak repaired but carpet stained and mildew smell. (Warranty 6)

August 2015- carpet was replaced from second water leak/mold issue. 2 days after I picked my car up I noticed marks on my back bumper and passenger seatbelt was not installed completely.(Continue of Warranty 6)

October 2015- shut my trunk lid and Chevy emblem fell off, also noticed a piece of paneling is missing from the back seat from it being torn down for water leak. I took it to dealership and have not heard anything back.(Warranty 7)

  7. I purchased a 2001 Ford Expedition in May 2015 and about to make my 3rd payment on it. The used dealership that it was purchased at fixed some of the problems (such as battery cables loose, new hood latch because the hood would not close, put on front shocks from air shocks cause one was blown, crack across the windshield). We expressed other concerns such as the back air shocks were also out causing the truck to lean to one side, the radio never worked, windshield washer fluid tank had a hole in it causing it to not hold fluid, and the gear shift was off center and would have to put the truck into neutral to start it. Now for over a week and 2 days it has been at the shop because it will not start at all. I have contacted the dealership many times and no one will call back or answer any of my calls and not the mention they knew of the problems I was having and said to contact them if anything happens. I had a body shop look at it and they changed the fuseable link and cam shaft sensor. Still would not start. So I had it towed to a different body shop to see if they could figure out the problem and today I was told that there are many things wrong with it and the biggest is the timing chain in the engine. It is going to cost more to fix the truck then it was to purchase it. What can I do about this? The dealership still will not return my calls.

  8. In December 2014 I bought a used 2012 Hyundai Santa Fe limited v6 with 40k miles on it, at the time of purchase I was made aware that the car had been a manufacturer buyback (lemon law) but I was assured any/all issues have been addressed. At the time I had asked if the dealer had any idea of what the problem had been and they told me it was something to do with the check engine light. There was no check engine light issue present when I bought it.

Fast forward to June 20th 2015 I’m pulling out of a grocery store parking lot and the car seems to stall so while coasting I throw the car in neutral and try to restart when I realize the car is still running… I’m unable to accelerate I lost power steering and brake assist. So I coast into another parking lot throw it in park and shut off the car then restart, at this point the car restarts and the check engine comes on and stays on but is drive able, I call the dealer closest to me(not the dealer I bought the car from) and am told they’re getting ready to close for the day and they don’t have any available loaner cars. So i decide maybe it was a fluke after a few hours of the car sitting the check engine light went away.

June 23rd Driving to work at a higher rate of speed the same thing happens again. I once again have to coast to a place where I can pull over throw it into park and shut off the car and restart the check engine light is on but car is drive able again so I go to work and call the dealer(dealer closest to me not the dealer that sold to me) they will have a loaner car ready for me and I can drop off after work.

The next day they called me and stated they changed this and that but wanted to keep it a few days to make sure problem stays gone. June 26th I get an update call fro the dealer stating they thought they had the problem fixed but it happened again.. They need to keep it longer and at one point the Service Advisor even said he’s got no idea what’s wrong with my vehicle. He states they’re working with a Hyundai Field Engineer and the Hyundai Tech line to resolve.

The dealer left me a voicemail on June 30th stating my car was fixed and ready to be picked up. I was out of town for work and didn’t get to pick up my car until July 6th. I picked up my car on July 6th and on June 10th the same issue occurred again while driving home from work (loss of acceleration, power steering, and brake assist) I called them and notified them the problem was back, and asked if they could find me another loaner car.

I dropped off the car. I didn’t hear back from the dealer until July 17th they called me to let me know they’re going to try replacing the car’s computer. and that it would be sometime next week before my car might be ready. The first time they had my car for 5 business days this time so far they’ve had my car for 7 business days and counting. I still havent heard back from from them yet.

To be clear the dealer working on my car is doing all they can, I see they’re really trying to get it fixed and be helpful. They dealer working on my car is not the dealer that sold me the car, the dealership that sold me my car is about 2 hours away each way and to bring it there each time it breaks down isn’t really feasible.

Upon doing some google searching for 2012 Hyundai Santa Fe loses power , I’ve found quite a few people share a similiar experience with this vehicle. So much so that in California there’s been a Class action lawsuit against Hyundai for these very problems.

I’m curious what my options are I keep hearing Illinois doesn’t have a used car lemon law, but I drive my daughter around in this vehicle(1 year old baby) and don’t feel safe at all not knowing when the problem will occur again. Even when I get my car back after the dealer replaces the car’s computer I suspect the problem will persist and I bought the car back in December of 2014 and financed something like 16- 17k on it I cant afford to keep making payments on a car that has a serious safety issue.

I feel like the dealer that sold me the vehicle lied to me , they assured me any issues with the car had been addressed but here I am having the same issue the previous owner had, a few months after buying it.
    Please advise

  9. I bought a 2013 GMC Yukon in Aug.of 2013. Brand new and had 18 miles on it when I left the Dealership. In February of 2015 I noticed that the front differential seal was leaking. I had 36,000 miles on it and the seal was replaced. Again last week on 8-7-2015 the same seal had to be replaced. I now have 48,000 miles on it. If it is replaced again in 3 months , would this be a lemon law issue? I have a factory 100,000 mile warranty on the drive train.

  10. I bought a 2005 Buick lacrosse xl in March 2015 and ever since I had it I’ve been getting it fix for every thing fuel injector brakes Spencers on both back of car and front senor hub barrier on drive side and still fixing on it. Does this law apply s to my car

I purchased a 2013 Ford Fiesta in March of 2013. It is now August 2015 and the clutch has been replaced 3 possibly 4 times. It is a known problem with Fiestas and Foucus, the dealership has replaced the clutch every time. Would my case fall under the Il lemon law?

  13. I have a 2015 VW Passat and have had it for 3 months. Since then, I have had to replace the windshield twice due to rocks hitting and breaking the windshield. Also have had a dead battery as well. This car continues to be trouble and it is brand new! What are my options?

  14. I purchased a new car in June of 2014. Since then the car has a had something draining the battery, and it doesnt start if sitting for 5 days or more(and I travel for business). I have had it in a manufacters dealer 4 times, and the total of those times, it was out of service for more than 30 days. The last time it was in the shop they thought it was fixed, they even were working with engineers from the manufacturer. Now it is past the 12 months, and the same problem has happened. Do I still qualify for Lemon Law?

  15. I purchased a 2015 Jeep Cherokee Sports on Sept. 18th on Schaumburg Jeep Dealer, Illinois. Two Days after I purchased, I drove on I-57 and stopped at the Rest area on Sept. 20, 2015 I found the front right wheel inside was burning and I can see the flame!!! 16. Hello
My fiance purchased a brand new 2012 chevy traverse abit over 2 years ago. It had 4 miles on it. The truck will just turn off while driving and restart a few minutes later. We have taken it back and forth many times to the dealer where it was purchased at. All they say is that they cant do anything until it happens to them while they test drive it and they never have. They just put it on the machine to see if any codes pop up. This is a big concern since i have my kids in the truck with me. I have even went further up than the dealer and all they say is they cant do anything.

  17. I purchased a 2006 Pontiac 2 months ago and have just made the second payment, they towed the car on this past Tuesday because it ran hot and was leaking some type of fluid, i have been trying to call and contact them for the last few days and i have been getting the run around, i heard from them today and they tells me the car is now fixed(even though i don’t know what was wrong with it) but they want to put me in another car which is an 2004 that i was going to get 2 months back ,but it had problems with the trans and the timing belt. I really feel like i’m being forced to accept the 2004 when i have had the 2006 for 2 months now, this to me seems a little fishy, is there anything i can do from this point?? Not to mention i have not rcvd any paperwork regarding my payments, like the payment book they promised and my plates or registration from the State, Please Help!!!!

  18. I bought a car from a buy here pay here lot. I know its not a new car but there has to be there has to be a law protecting me . 19. I purchased a 2010 Mercury Milan in October of 2014. 3 days after having a certified vehicle the engine light went one, leaky fuel cap. Had that replaced. Then R tail light went out, paid to have fixed. Then had throttle body problems that almost caused a severe accident on highway. After 2 visits to dealer they finally figured it out. Was replaced and I was told if it still jerks the transmission ,it’s due to different drivers. About a month ago the L tail light went out, this time covered under lifetime recall. Every time tail lights go out, headlight need to be replaced. I feel there is an electrical issue, but was told very costly to detect. I had oil change and was told leak was starting in the front boot and not to worry until leaking more. I took the car to the dealer and the whole front drive shaft needed to be replaced. I went a full month and check engine light came on.
Now I need to return to dealer for a possible leak in fuel hose that goes from gas cap to tank. When does this downward spiral end?

  20. We purchased a 2015 Misubishi Lancer, new from Max Madsen Mitsubishi Aurora, IL. Within a week of driving the car, my husband’s back had been injured so severely that he was unable to work for near 3 weeks. Multiple insurance agents viewed the car and confirmed the driver’s seat was installed crooked. He went to the dealership to inform them of the issue. A member of the service team “took a look at it” and said it “was fine” and that the would not do anything further. What would be our next step in the process to have this corrected? Do we have any recourse?

  21. My son purchase a 2007 dodge charger from one of those corner lots in October 2015, the car ran very quietly and seem to be a good car a warranty did come with it and he didn’t purchase one now two months later he started hearing a slight knock in the engine. He took it back and was told that the timing chain is going bad and wants to charge about $650 to fix is there any thing that can be done about this

  22. We. Bought a 2002 ford explorer in 2015. Not one day later…..the brakes started throwing out dust from the rotors and I was almost in an accident . The c shafts are bad the transmission went out and the car was only driven for two weeks to a month since then I’ve attempted to call the dealership after they told me they’d find me a new car…..I get no return calls nor have I got another vehicle….. Would I qualify

The trunk doesn’t open, the doors don’t lock, and the rear differentials went bad on me. I’ve literally been having problems with this vehicle since the first day I got it. I complained to the dealership and they told me so many lies and kept lying, giving me the run around about reparing it. I got fed up and just put it in a mechanic shop and I’m still waiting for it to get fixed. Although this is a 2009 used car, is there any help or do I have to deal with this on going, annoying, yet irritating problem??

    Thanks in advance!

  27. 28. I purchased my vehicle 2015 Jeep Renegade Trailhawk on 8/31/15. After one failed attempt at fixing a perceived minor electrical problem the vehicle has been with the dealer since Dec 10,2015 exhausting all their options (some large like replacing body harness) to resolve the issue. FCA is involved and supplied a case manager to oversee the repair on 1/20/16, with the direction an FCA engineer was going on site to assess problem. Its 2/6/16 and I am still 1 week away from the engineer arriving at my dealer to assess. This has all the markings of a Lemon I have purchased, so do I have recourse here or do I need to see out the Case mgr led repair which will be in the 60 calendar days range my vehicle is at the dealer awaiting repair?

  29. I just purchased a 2010 town & country for 11,500. The thing stalled and will not fire back up. The dealer I got it from said to tow it in. They are now trying to charge me to fix it. I’ve had it less than 30 days. What can I do? I don’t feel I should be responsible for the bill.

  33. Let me start from the beginning. On 3/26, I took delivery of the vehicle from Schaumburg Honda Automobiles, Schaumburg, IL. After driving couple of days, I started to notice there is sound re-production is not well so I thought that it might be the audio settings to tune with. I make the changes in sound settings by changing BASS, TREBEL as well Subwoofer. After making changes to the audio settings, still there is an issue with the sound quality. At least I’m not expecting this kind of worst sound quality from the premium audio system. After few days, I’ve noticed that what settings which I’ve made for volume is changed to the lowest level at 10 and I correctly remembered that I’ve set to 15. I thought it might be my oversight so I’ve continuously observed the behavior. Finally, On 4/26/2016, I’ve reported issue with the stereo due to the settings were not saved and sound quality is not good specifically with the FM and XM. The RO# for first visit is 1163282. After investigation, the service advisor reported back that there is nothing wrong with stereo (REPAIR ATTEMPT #1).
I was not convinced with the response. After that incident I’ve started continuously monitoring the stereo performance. On 4/28/2016, I’ve noticed that the stereo screens are not changing when I change the channels on the radio. I thought that might be intermittent issue and ignored at that day. On subsequent days, I’ve noticed that the stereo screen is freezing and it does not correctly report currently playing channel. So I took my vehicle to the dealership on 5/02/2016 and explained the service advisor what is happening and showed him a video about the stereo behavior. The service advisor opened up the RO# 1164181. After the investigation, I got call from the service advisor that my vehicle is ready to be picked up. So I went to dealership to pick up the car. When I saw the RO, I was surprised that the service advisor has not correctly reported the issue. in the report service advisor mentioned that “THE RADIO INTERMITTEN LOCKS UP AND HE CAN NOT CHANGE STATIONS 56 DEFAULT”. And the technician reported that “TEST DROVE VEHICLE RADIO WORKING FINE NO ISSUES TOUCH SCREEN”. In fact, I can change the station which is not displayed on the screen and the screen shows the previous played station. Due to the incorrect reporting from the service advisor, the technician cannot find the issue as the stereo does changes the station but it does not displays the information of currently played station. I expressed my concern about the incorrect reporting and the service advisor said that I can make change in to the RO and give me the copy of it. My concern was that if the service advisor is not documenting the issues correctly for the repair technician, the repair technician may not able to identify the issue. So as a documentary proof, I denied not making any change in the RO and drove back. (REPAIR ATTEMPT #2)
In the morning of 5/03/2016, the issue again comes up and I went back to the dealership to report the issue. This time, the other service advisor has seen the issue and acknowledges it. He re-opened the previous RO 1164181 for further investigation. After the feedback from Honda, they replaced the Tuner board in car. (REPAIR ATTEMPT #3)
In the morning of 05/09/2016, the same issue arises and I went to dealership to report the problem and for resolution. The service advisor told me that they have to replace the entire stereo unit. (REPAIR ATTEMPT #4)
To summarize this, till this writing, I have to visit dealership 4 times to fix the issue with the stereo and still don’t have any idea what will be the outcome.

  35. In the past I purchased a used Nissan vehicle in which it turned out to be a lemon due to the deception of the manufacture warranty label that on the vehicle. I won my case and returned their vehicle. That was over 20 years ago. Looking to purchased a used vehicle this year, what should I look for and how does the lemon law applies now to a used vehicle in IL.

  36. I purchased a 2012 Durango new in 2012 from the dealer. I live in Illinois and have had the car in for air conditioning work every summer since the purchase. Can the lemon law apply in this instance, where it would not have been possible to have the fixes in one year since the AC is only used in the summer?

  37. I bought a 2008 BMW in 2014 had many many problems tried to trade it and found out it was a Lemon Call back in 2013. I verbally asked about the car When I bought it and was re assured it was fine but no one told me it was a Lemon Call back. The dealer I bought it from said in one of the documents I signed at closing that in there was something about a dealer buy back. It may have been but nothing to my knowledge about a Lemon law was said to me. Do I have a case to get compensated from the dealer?

  38. We bought a brand new Jeep Grand Cherokee in April of 2014. We have had nothing but issues over the past 6 months with the electronics in the car. The car has actually been in the shop for a total of 60 days on and off for the past 3 months and is heading back there. The computer is not working which includes the radio, gps, etc. Does the lemon law apply to us?

  39. I bought a 2015 can am spyder new in 2015.

  40. Car purchased used in Illinois from Autobahn in Evanston in August 2016, it is December 2016 its been in the shop twice and had hundreds of dollars of repairs each time. After it was starting weird I figured the cold was bothering the battery so I went to get it checked out. This mechanic, the 3rd who is a serviceman at Walmart, pops up the hood noted the fact that there was a strange amount of rust and it seemed like a flood car. This struck a chord with me because the 2nd mechanic I had look at it told me they found strange issues that were normally associated with cars with twice as many miles on it. They showed me the parts that were removed and either they were rusty beyond recognition or they were broken. The car I bought only had about 51,000 miles on it! It was practically new in the interior! How do you explain what’s wrong with this car other than it being in a flood???

I contacted Mazda nearly a month after I bought the car about it having issues and the cowards hid behind the fact that I purchased the vehicle As-Is. I am a college student scrapping by literally, I saved money to by that car and I was practically broke after buying it. I needed it to get to work and school.

    This is outrageous!
