Alabama Lemon Law

What Is the Alabama Lemon Law?

The Lemon Law in Alabama provides legal remedies for consumers that buy defective cars, motorcycles and trucks. Specifically, the Alabama Lemon Law applies to any new motor vehicle that falls under the following parameters:

  • It is primary operated on public roads and is self-propelled.
  • It is registered for a gross weight of 10,000 pounds or less.
  • It has at least one defect or nonconformity that substantially impairs its use, value or safety.
How Do I Know If My Vehicle Is a Lemon?

Automobile manufacturers are obligated to repair any defect in a consumer’s motor vehicle within a reasonable number of repair attempts. Under the Alabama Lemon Law, a “reasonable number of attempts” means either one (or both) of the following:

  • The motor vehicle was taken to an authorized dealership for repairs at least three times for the same defect within the first two years after its purchase, or before the vehicle was driven 24,000 miles, with at least one repair having occurred in the first year after purchase or before the vehicle was driven 12,000 miles, and that defect continues to exists; OR
  • The vehicle was out of service as a result of its repairs and defects for thirty or more calendar days within the first two years after its purchase, or before the vehicle was driven 24,000 miles, with at least one repair having occurred in the first year after purchase or before the vehicle was driven 12,000 miles.

"What Will the Manufacturer Do for Me If My Vehicle Is a Lemon Vehicle?"

If your vehicle is a lemon in Alabama, you are eligible to have the manufacturer repurchase the vehicle or replace it with a new one. Alternatively, you might also be entitled to receive a “cash-and-keep” settlement, wherein you would receive monetary compensation based on diminished value of your vehicle as a result of its defects and repairs.

Kelsey is an Alabama consumer who sought our assistance in connection with a number of issues that she was experiencing with her new Audi Q5. Kelsey took her vehicle to an authorized Audi dealer on several occasions, and it was out of service for approximately 59 days before it had been driven 3,500 miles. Kelsey was in need of an Alabama consumer attorney that focused on Lemon Law cases, and ultimately agreed to have our firm represent her. Throughout the course of her case, we attempted to negotiate a settlement directly with Volkswagen, and after just a couple of months, we were able to convince Volkswagen to repurchase her defective vehicle.

Even if your vehicle does not technically fall under the qualifications of the Lemon Law, you might still be entitled to receive cash compensation under the Magnuson-Moss Warranty Act, the federal lemon law that applies to any defective product that comes with a manufacturer’s warranty. This law also requires the manufacturer to pay the consumer’s attorneys’ fees, so we do not have to charge our clients for our services.
