Hawaii's Lemon Law Complaints- 2007

Hawaii car buyers recovered more than $490,000 last year from car complaints filed under the state's Lemon Law, according to the Department of Commerce and Consumer Affairs.

Toyota and Honda had the lowest numbers of lemon law complaints compared to their market shares, the DCCA said. Toyota received only five complaints, or 7.6 percent of all complaints received compared to its market share of 30 percent. Four of the complaints were later withdrawn. Honda also only had five complaints and a market share of 14.5 percent.

Ford, with a market share of 8.9 percent, and General Motors, 8.8 percent, both received 12 complaints each.

Nissan had nine complaints in 2007 and a 12.8 percent market share, followed by Chrysler with eight complaints and 6.1 percent market share.

Hyundai had three complaints. BMW, Land Rover and Mercedes-Benz each had two complaints.

Audi, Isuzu, Jaguar, Kia, Mazda and Volvo all had one complaint each.

Isuzu To Stop Selling Cars In the US

— Isuzu sold 11,301 passenger vehicles nationwide in 2007. Its top-performing dealer, All-Star Isuzu in Corpus Christi, sold 356. Compared with the more than 2.6 million Toyotas sold nationwide, it's understandable why Isuzu announced last week that it would stop selling cars and light trucks in the United States.

Officials with the Corpus Christi dealer did not return calls Friday to answer how Isuzu's decision would affect All-Star.

Chip Letzgus, a spokesman for the Japanese-based company's North American division, Isuzu Motors America, identified All-Star as the company's top dealer. Announcement of the pullout was made on Jan. 30, hours after Isuzu notified employees and dealers, Letzgus said.

General Motors Corp. built the Japanese company's most recent models and GM decided to stop production on those. Isuzu was unable to find another manufacturer for those vehicles, Letzgus said.

"In the absence of new products to sell, Isuzu Ltd. in Japan decided to discontinue the sale of passenger vehicles in the U.S.," he said.

Isuzu will continue to sell its commercial trucks in the United States. The company sold 22,655 in 2007. It also builds component parts for other manufactures, such as Nissan.

Isuzu shares closed on Friday at $3.90, down from $5.80 a year ago but up from $3.65 a month ago.

Dealer "Squeezed" For Violating Consumer Fraud Act & Used Car Lemon Law

Berlin New York based auto dealer Chevrolet 73, Inc., will pay $200,000 to settle charges it violated New Jersey's Consumer Fraud Act and Used Car Lemon Law, the state said this week.

The dealership also agreed to comply with state and federal laws in the future.

In a lawsuit filed in November 2006, the Office of the Attorney General and the Division of Consumer Affairs alleged that the dealership failed to honor advertised prices, failed to disclose all terms and conditions of a negotiated deal, and failed to disclose the mechanical condition of some used cars. The company does business as Chevrolet 73 and Chevrolet 73 Bargain Corral.

"Consumers are entitled to be told all the relevant facts before they purchase a vehicle. Under this settlement, the dealership will provide this information so consumers can make an informed decision," Attorney General Anne Milgram said in a statement.

The dealership also will participate in the Division's Alternative Dispute Resolution program for three years, and will respond to any complaints brought to it by the division within 30 days. Unresolved complaints will be forwarded for binding arbitration.
